Fee adjustments:
Effective October 1, 2009, Stormwater Construction Permit
(5G3-NJ0088323) Request for Authorization (RFA) applications will no
longer be accepted and processed along with your Soil Erosion and
Sediment Control Plan application* by the local Soil Conservation
District. Permittees are required to submit their applications
and payment electronically online utilizing the NJDEP’s Stormwater
Construction Activity E-Permitting System or, via paper application to
the NJDEP’s Bureau of Permits Management. Information and instructions
for completing and submitting RFAs utilizing either process may be
accessed through the NJDEP webpage at
http://www.nj-gov/dep/stormwater/.
This changed does not
affect the Soil Erosion and Sediment Control Plan approval process.*
Soil Erosion and Sediment Control Plan applications must still be
submitted to the local district offices for certification. However, for
those projects requiring a NJDPES Stormwater Construction Activity
permit, the district shall issue a SCD Certification Code to the
permittee verifying that the 251 Plan has been approved. This code is
necessary to complete either the online E-permitting and/or paper RFA
process.

*Information completed
on the RFA e-permit application must be consistent with the information
submitted on the Soil Erosion and Sediment Control Plan application.
Effective January 5,
2009, the permit fees for the Phase II Stormwater Construction General
permit (NJ0088323) will be increased and bifurcated. This notification
is in conjunction with adopted modifications to the NJPDES Rules at
N.J.A.C. 7:14A appearing in the January 5, 2009 N.J. Register and are as
follows:

1.0 – 5.0 acre disturbance
- $450.00
·
Great than 5.0 acre
disturbance - $650.00
All fees remain
payable by check, money order or public agency voucher; made payable to
Treasurer, State of New Jersey. Public schools, religious and
charitable institutions remain fee exempt.
Construction
projects less than one acre but part of a larger plan of development
continue to be subject to the policies outlined in the Stormwater Permit
Program, Phase II Manual, Section 20.4.
Note: Any transfer in ownership
must result in a New Soil Erosion & Sediment Control Application.
The owner is the responsible party for the Soil Erosion & Sediment
Control throughout the completion of the construction project.
What Requires a SESC
Plan Certification
A
"Project" means any disturbance of more than 5,000 square feet of the
surface area of land for:
Building Permit
and/or Construction Permit - the accommodation of construction for
which the State Uniform Construction Code would require a construction
permit, except that the construction of a single family dwelling unit
shall not be deemed a "project" under this act unless such unit is
part of a proposed subdivision (major & minor), site plan, conditional
use, zoning variance, planned development or construction application
involving two or more such single family dwelling units.
Demolition
- the demolition of one or more structures in which such activity will
disturb 5,000 square feet or more of the surface of the land.
Parking Lots
- the construction of parking lots in which such activity will disturb
5,000 square feet or more of the surface of the land.
Public Facilities
- means any building; pipeline; highway; electricity, telephone or other
transmission line; or any other structure to be constructed by a public
utility, municipality, county, or the State or any agency or
instrumentality thereof.
Quarrying & Mining
- the operation of any mining or quarrying activity.
Clearing & Grading
- the clearing and grading of any land for other than agricultural or
horticultural purposes.
